Seapointe Realty Terms & Conditions for Rental Guests
Office Locations
Main Office
9900 Seapointe Boulevard (use 9900 Atlantic Avenue for GPS), Wildwood Crest, NJ 08260.
If arriving via NJ-47 S/Rio Grande Ave., turn right onto Atlantic Avenue and continue 2.2 miles to Seapointe Realty. From Exit 0/Ocean Drive, continue on Pacific Avenue upon entering Wildwood Crest, turn right on Rochester Avenue, then right on Atlantic Avenue. Proceed one block to Seapointe Realty.
Curbside Check-in & Branch Office
Effective May 15, 2024, all check-ins for Seapointe Village and Ibis rentals occur at the branch office at 9700 Pacific Avenue (between Memphis & Rochester Avenues), Wildwood Crest, NJ.
Directions to Curbside Express Check-in
- From Wildwood Blvd. (Rt. 47): After the George Redding Bridge, turn right onto Pacific Avenue and continue ~2.2 miles to 9700 Pacific Avenue on the right.
- From Garden State Parkway South (Exit 0): Continue on NJ-109 S, turn left onto Ocean Drive, continue 2.7 miles (becomes Pacific Avenue in Wildwood Crest) to 9700 Pacific Avenue on the left.
Check-In & Check-Out
Check-In: 4:00 p.m.
Check-in occurs at a Seapointe Realty office. You will be notified of the office location at least 10 days before your lease begins. At check-in you will receive your parking pass(es), gate card, recreation pool/beach tags, and keys. No check-in items are distributed before 1:00 p.m. We strive to have the property ready by 4:00 p.m., but unforeseen delays can occur. Early arrivals may enjoy Seapointe Village amenities starting at 1:00 p.m.
Check-Out: 11:00 a.m.
Late check-outs cannot be accommodated. A fee of $100 per hour applies after 11:00 a.m. until check-out is completed; fees are charged to the card on file.
Reservations, Payments & Insurance
Reservation Deposit & Payment of Rent
- At booking: 50% of rental rate plus non-refundable $150 reservation fee and non-refundable $89 security deposit waiver.
- Balance: Remaining 50% due 45 days prior to check-in and will be automatically charged to the original payment method.
- Travel Protection: Standard Travel Protection may be added at booking, at any time 30+ days from check-in, or within 5 days of booking if fewer than 30 days remain. Cancel For Any Reason (CFAR) is only available to eligible travelers at booking or within 14 days of booking and cannot be purchased fewer than 30 days before check-in.
Trip Cancellation & Travel Insurance
Travel insurance is strongly recommended to protect deposits and prepaid, non-refundable amounts against covered risks (e.g., illness, accidents, weather delays, employment changes). CFAR coverage (additional cost) reimburses up to 60% of prepaid non-refundable charges for certain non-covered reasons. Standard Travel Insurance costs 7% of your reservation invoice; adding CFAR increases the cost to 10.8%. Premiums are generally non-refundable after 15 days. To initiate a claim, call 833-610-0736. If you decline insurance, refunds follow the rental agreement terms.
Security Deposit Waiver (SDW)
The SDW provides coverage for unintentional, accidental damage to the rental residence during your stay, up to $10,000, eliminating a traditional security deposit. Examples include carpet spills, furniture tears, broken lamps, and screen doors. Intentional damage and pet damage in non-pet-friendly residences are excluded.
All tenants are automatically enrolled for a non-refundable fee of $99.00. You must report damage during your stay; unreported or excluded damage will be charged to your account.
Your Responsibilities Regarding Damages
- Report accidental damages to Seapointe Realty when they occur.
- Verify damages upon request.
- Notify police in case of loss by theft.
- Take reasonable steps to protect property from further damage.
Cancellations & Changes
Cancellations must be submitted in writing via email to reservations@seapointerealty.com.
- More than 45 days before arrival: Refund minus a $300 cancellation fee and all non-refundable fees (including any insurance premiums and administrative fees).
- Within 45 days of arrival, no-shows, or early departures: Forfeit total payment. Guests with travel insurance may be protected if the policy covers the reason.
- Move requests: $125 move fee applies to guest-initiated changes after advance payment.
- Payments must be received by due dates to avoid cancellation and applicable fees.
- No accommodation changes within 45 days of arrival.
- Possible refunds are subject to adjustment if travel bans or rental prohibitions are enforced by authorities during the rental term.
Accommodation Selections
Upon receipt of deposit and a signed agreement, the specific unit selected will be reserved for your stay, subject to availability for maintenance, owner usage, or other issues that render the accommodation unsuitable, and provided the property remains in Seapointe Realty’s program. If a reserved unit becomes unavailable, your options are a full refund or an equivalently priced accommodation if available. Seapointe Realty is not responsible for direct or indirect costs, expenses, or consequential damages arising from unit unavailability. Seapointe Realty is not responsible for location, size, contents, or mechanical deficiencies. Sleeper sofas may be part of occupancy; comfort levels vary.
Occupancy
Each property has a maximum occupancy that must not be exceeded. Overcrowding or events that exceed maximum occupancy are prohibited and may result in immediate eviction without refund.
Prohibited Activities
- Smoking: Prohibited in all accommodations (including balconies/patios). Smoke only in designated areas of Seapointe Village. Violations: $500 plus cleaning costs and possible eviction.
- Pets: Not permitted in any accommodation. Violations: $500 plus cleaning costs and possible eviction.
- Illicit/Illegal Substances: Strictly prohibited; may result in immediate eviction.
- Subletting: Prohibited.
- Excessive Noise: Quiet hours 11:00 p.m.–7:00 a.m. per Lower Township ordinances. Disruptive noise can lead to eviction.
- Parties/Events: Weddings, receptions, parties, or large gatherings are not permitted. Violations may result in eviction and forfeiture of rent.
Parking Passes & Regulations
- 1-bedroom, 1-bedroom + den, and 2-bedroom residences: 1 vehicle pass.
- 2-bedroom + den, 3-bedroom, townhomes, and single-family homes: 2 vehicle passes.
- Townhomes and Ibis residences must use their garages or designated spots.
- Passes must be displayed; valid from check-in to check-out and must be returned at check-out.
- Charges may apply for violations. Oversized vehicles and rooftop carriers may not fit in garages; Seapointe Realty is not responsible for related damage.
Arrival Inspection & Pre-Existing Damage
Inspect the residence within 24 hours of check-in and promptly report issues with furniture, appliances, or fixtures to Seapointe Realty. No refunds or considerations are provided for items not reported. Refusal of access for repairs waives rights to refunds or compensation. Post-departure inspections assess damage, loss, or breakage; costs will be deducted from the security coverage or charged to you. You are responsible for any amount exceeding coverage limits.
Appliances, Services & Utilities
No refunds for malfunctioning appliances, HVAC, electronics, internet, or cable. Repairs are scheduled based on vendor availability. Due to the coastal wetland environment, no refunds for pest-control issues. No refunds for utility interruptions (power, water, flooding, etc.).
What to Bring
Guests must supply: bed linens (fitted/flat sheets, pillowcases), beach/pool towels, toilet paper, paper towels, detergents/soaps, trash bags, and cleaning supplies.
Guest Responsibilities Before Departure
- Wash, dry, and fold all bath and kitchen towels; return to original locations.
- Clean and put away all kitchen items; empty the dishwasher and sink.
- Dispose of all trash properly.
- Return furniture to original positions.
- Remove all personal items, including food.
- Ensure no residence items (e.g., towels, remotes) are taken.
- Return the check-out envelope with beach/pool tags, gate card(s), garage door opener (if applicable), and keys to Seapointe Realty by 11:00 a.m.
Incidental Charges
Guests are responsible for excess accidental or malicious damages (not covered by insurance), lost items (tags, keys, gate cards, garage door openers), NSF check charges, and similar costs. Charges may be paid by credit card or check.

Once received, the office will call the provided cell number for pick-up. Seapointe Realty is not responsible for lost, damaged, or delayed deliveries. Returning late deliveries after departure will incur an additional fee plus shipping.
Entry to Property
Seapointe Realty may enter the residence as needed for repairs, maintenance, or services, to verify agreement compliance, or in emergencies. Reasonable advance notice will be attempted when possible.
Weather & Events Beyond Control
No liability or refunds for circumstances beyond control, including construction or event noise, wildfire/smoke, weather-related interruptions, road closures, or natural disasters. Travel insurance, including CFAR, is strongly recommended.
Restrictions
Tenants must follow all Rules and Regulations and Swimming Pool Rules of the Seapointe Village Condominium Associations and ensure all occupants comply. Tenants are responsible for the actions of their family, guests, and any occupants.
Liability Exclusion
The tenant agrees to defend and indemnify Seapointe Village Realty (SVR), the property owner, the applicable Seapointe Village Condominium Association, and their employees and agents against loss, theft, property damage, or injury arising from use of the property or facilities. SVR is not responsible for actions of the Seapointe Village Condominium Associations, including service disruptions or amenity availability. Amenities may be unavailable at times, including pre- and post-season, at the Master Association’s discretion.
Indemnification
Tenants agree to defend, indemnify, and hold SVR, the property owner, the Seapointe Village Master Association, and their employees and agents harmless from claims, damages, liabilities, and expenses (including attorney’s fees) related to use of the property, the rental agreement, or Seapointe Village facilities. Tenants also represent they have had no recent contact with anyone who has tested positive for COVID-19.
Claims
All claims must be brought in the New Jersey State Courts located in Cape May County. SVR may recover reasonable attorney’s fees and litigation expenses incurred in enforcing the agreement or defending claims.
Seapointe Village Master Association Key Rules & Regulations
All posted rules apply to use of Association facilities, including swimming pools, hot tubs, private beaches, playgrounds, basketball and tennis courts, fire pits, barbecue grills, exercise and steam rooms, and recreation rooms.
No Smoking
Smoking is prohibited on the beach and in common areas inside and outside Seapointe Village, except in designated smoking areas.
Recreation Tags
Recreation tags (pool/beach tags) are required for facilities. Wear or produce upon request by tag inspectors or Seapointe Village Security.
Swimming Pools & Hot Tubs
Tags required. Obey lifeguards. No glass. Children under 16 are prohibited in hot tubs. Additional rules are posted at each pool entrance.
Children’s Safety
Minors must be supervised in common areas and buildings. Bicycles, rollerblades, roller skates, and scooters are not allowed in garages, building interiors, recreation decks, or on beach boardwalks. Skateboards are prohibited.
Storage of Beach Items & Bicycles
Do not bring beach items or bicycles into buildings; store them in your vehicle.
Beach & Ocean
Swim at your own risk. In-season lifeguards: 10:00 a.m.–5:00 p.m., weather permitting. Report disturbances to a lifeguard. Kite flying is prohibited between 10:00 a.m. and 5:00 p.m. Fishing is allowed before 10:00 a.m. and after 5:00 p.m. from May 1 to September 15. Do not feed seagulls. Follow posted signage. Vehicles and watercraft (including jet skis, wave runners, ATVs, boats) are prohibited on the beach. No watercraft launching from Seapointe’s shore.
Parking, Streets & Garages
Obey street signs and speed limits. Use the gate card at the Atlantic Avenue gatehouse. Display parking tags while parked. Observe garage clearance heights; most rooftop carriers will not fit. Park only where permitted and within lines. One vehicle per condominium unless otherwise specified: two-bedroom + den and three-bedroom units may have two vehicles; townhomes have two garage spaces and vehicles must be parked in the garage; single-family homes typically have two spaces (garage + driveway). The plaza deck driveway circle is for pick-up/drop-off only. No trailer parking. Motorcycles may operate only with minimal noise. Vehicles with rooftop carriers or exceeding garage clearance must park off-site (e.g., on Rochester or Seaview Avenues).
Balcony Areas
Do not hang towels on railings or use balconies for storage. Do not feed birds or throw/discard items from balconies.
Municipal Ordinances
Lower Township laws apply, including curfew. No one under 21 may possess or consume alcohol on common property.
The Seapointe Village Master Association Covenants Committee may revoke privileges, evict individuals, or issue monetary fines for violations. A complete set of Rules and Regulations is available at the Association Management Office in the North Beach building lobby (9900 Seapointe Blvd.) or by contacting Seapointe Security at 609-729-0660.
Additional Notes
Certain rules and procedures may differ for properties outside Seapointe Village (e.g., Penthouse at the Pan American, Ocean Sands, Oceana Condominiums, or other Diamond Beach and Wildwood Crest areas). Refer to your Occupancy Agreement or contact the Seapointe Realty office at 609-729-7100.
Properties are individually and privately owned. While accuracy is a priority, errors may occur across website and marketing materials, and photos may differ from current appearance. Seapointe Realty reserves the right to make corrections or changes as needed.
